Vancouver Criminal Defense and Drunk Driving Lawyer
At the Clark County-based Law Office of Mark Muenster in Southwest Washington, I focus on the following areas of practice:
DUI
When facing DUI charges, you must be aware of both the criminal and the administrative consequences of your arrest. Timing is everything if you are looking to retain your license. Without attending to the necessary steps of a hearing before the Department of Licensing, you could lose your driver's license prior to any court action. While there are challenges in fighting a DUI charge, you do have options. Those options include seeking alcohol treatment, and even the chance for deferred prosecution, which avoids a conviction for drunk driving on your record.
Firearms and Rights Restoration
At the Law Office of Mark Muenster, I represent clients looking to have their civil rights restored. In Washington, a conviction of a felony or certain misdemeanors will result in you losing the right to own or carry a gun. Two common areas that result in the loss of firearm rights are domestic violence and 4th-degree assault. At sentencing, defendants are told that the firearm disqualification is permanent, which is not quite accurate. There are waiting periods for misdemeanors and felonies before you can re-apply to get your rights back, but you must take legal action if you do not want the firearm ban to be permanent.
Appeals
Prior to establishing my criminal defense practice in Southwest Washington, I worked for the Washington Appellate Defender Association (WADA). That experience gave me hands on experience in researching and writing briefs for appeals. I participated as one of the attorneys of record in more than 65 published decisions in the Washington Supreme Court and Washington Court of Appeals. I have also done appellate work in the 9th Circuit Court of Appeals. I have worked on two death penalty appeals in Washington. As your attorney, I will put all that experience to work with you if you are looking to appeal a conviction.
Sex Crimes
A sex crime charge carries almost as strong of a stigma as a conviction. No matter how adamant a client may be about his or her innocence, society is more than willing to assume the worst even if the charge is a mistake or fabrication. The requirement for sex registration compounds the penalties. You need an attorney who can tell your side of the story to a skeptical prosecutor or a skeptical jury.
