Domestic Violence

An arrest for a "domestic violence" offense can be a completely unsettling experience.

Even a simple argument at home can sometimes lead to the police being called. Once at your house after a 911 call, the police are obligated by statute to make an arrest if they have "probable cause" to believe that an assault has occurred. They will arrest the person whom they think is the "primary aggressor" if the situation seems ambiguous.

If arrested, you may be held in jail until served with a "no contact" order between you and your spouse, significant other, or relative, if he/she is the "complaining witness", (or as the police like to refer to them, the "victim".) For a weekend arrest, this means possibly being detained until a judicial hearing on Monday.

A conviction for a crime involving "domestic violence" whether for a misdemeanor or a felony, has serious consequences. You will lose the right to own or possess a firearm. You may have difficulty finding or keeping employment. You may have difficulty obtaining rental housing if a background check is done which reveals the domestic violence conviction.
